The following terms apply to all services and appointments agreed between JaNatEmi Massage Praxis and its clients.
These General Terms and Conditions apply to all services and appointments agreed between JaNatEmi Massage Praxis, Owner: Natalia Gedik, Wimgarten 3, 2552 Orpund, Switzerland, hereinafter referred to as the “Practice”, and its clients.
Where these Terms and Conditions have been appropriately brought to the client's attention before or at the time the contract is concluded, they form part of the contractual relationship.
The Practice provides massage and related services intended to promote relaxation, recovery and general well-being. Unless expressly stated otherwise and unless the necessary professional requirements are fulfilled, the services offered do not constitute medical treatment.
No guarantee of healing, therapeutic success or any particular outcome is given. Clients with existing or suspected health conditions may be advised to seek medical advice before receiving a massage.
Appointments may in particular be arranged by telephone, email or through any other contact or booking options expressly offered by the Practice.
A contract is concluded once the appointment has been confirmed by the Practice or otherwise bindingly agreed between the parties. Clients are responsible for providing accurate contact information.
The prices communicated when making the appointment, published on the website or shown in the current price list apply. Prices are stated in Swiss francs (CHF).
Where required by law, the displayed final prices include VAT and any other mandatory surcharges. The price communicated at the time the appointment is agreed generally applies.
Unless otherwise agreed, the fee for the service is due immediately after the treatment. Accepted payment methods are communicated at the Practice or when the appointment is arranged.
Appointments may be cancelled or rescheduled free of charge up to 24 hours before the agreed appointment time.
Where an appointment is cancelled less than 24 hours in advance or the client fails to attend, the Practice reserves the right to charge for the reserved appointment up to the amount of the agreed treatment price insofar as the appointment could not be allocated to another client.
Where there is a substantiated important reason for the cancellation, the Practice may waive all or part of the charge at its discretion. Mandatory statutory rights remain unaffected.
If a client arrives late, the duration of the treatment may be reduced if subsequent appointments do not permit an extension. Where the delay is attributable to the client, the agreed price generally remains payable.
Certain medical or health circumstances may make a massage unsuitable or require special precautions. Clients must therefore inform the Practice before the treatment begins of any circumstances that could be relevant to the safe provision of the massage.
These may include, in particular, acute illness or fever, infections, inflammation, skin conditions, recent injuries or surgery, known thrombosis or thrombosis risks, significant cardiovascular conditions, pregnancy or other relevant health concerns. This list is not exhaustive.
Where there is uncertainty, the Practice may recommend obtaining medical advice before the massage. For health or safety reasons, the Practice may refuse, adapt or discontinue a treatment.
Pregnant clients should inform the Practice of their pregnancy before the massage begins. Depending on the stage of pregnancy, the client's health and the requested treatment, the massage may need to be adapted or prior consultation with an appropriate healthcare professional may be advisable or necessary.
The effects of massage vary from person to person. A particular result can therefore not be guaranteed. The services provided by the Practice do not replace medical diagnosis, physiotherapy, psychotherapy or medical treatment where such services are required.
The Practice provides its services with appropriate care and to the best of its knowledge within the scope of its activities. Liability is governed by the mandatory provisions of Swiss law.
To the extent permitted by law, the Practice is not liable for disadvantages resulting from a client's failure to disclose relevant health information, or from incomplete or incorrect information provided despite an appropriate request. Liability for damage caused intentionally or by gross negligence is not excluded.
Where the Practice offers gift vouchers, the conditions communicated at the time of purchase or stated on the voucher apply. Gift vouchers are generally not redeemable for cash unless mandatory law provides otherwise. Mandatory statutory limitation periods remain unaffected.
If an appointment cannot be provided due to illness, force majeure, technical problems or another circumstance that could not reasonably have been avoided, the Practice may cancel or reschedule the appointment.
Payments already made for a service that is not provided will be refunded or, with the client's agreement, credited towards a replacement appointment. Any additional claims are subject to mandatory applicable law.
Personal data is processed in accordance with the Privacy Policy published on the website and applicable data protection law. Health-related information is handled with particular care.
The Practice may amend these Terms and Conditions for future contractual relationships. For an appointment that has already been bindingly agreed, the terms accepted at the time the contract was concluded generally continue to apply.
If any provision of these Terms and Conditions is wholly or partly invalid or unenforceable, the remaining provisions remain unaffected. The applicable statutory provisions replace the invalid provision.
Swiss law applies. Mandatory statutory rules on jurisdiction, including mandatory provisions protecting consumers, remain unaffected.
